By using the nGRND Gold Protocol Inc. (“nGRND”, “We”, “Our”) platform (“Platform”), you confirm that you accept these terms of use and that you agree to comply with them.
If you do not agree to these terms of use, do not access or otherwise use this Platform, any services available through this Platform or any information contained on this Platform.
1. Changes And Updates to Our Terms
We may revise these terms of use at any time by amending this page. As a user of this Platform, it is your responsibility to check this page from time to time to take notice of any changes We make, as they are binding on you.
2. No Reliance, Advice or Formal Legal Relationship
The content on Our Platform is provided for general information only and is not intended as advice (including investment, legal or any other form of advice) on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content provided on Our Platform.

Nothing in these terms of use excludes or limits Our liability for death or personal injury arising from Our negligence, or Our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by relevant law.
To the extent permitted by law, We exclude all conditions, warranties, representations or other terms which may apply to Our Platform or any content on it, whether express or implied.
We will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
- use of, or inability to use, Our Platform; or
- use of or reliance on any content displayed on Our Platform.
We will not be liable for any loss of profits, tokens, revenues or anticipated savings (in each case whether direct or indirect), trading losses, investment losses, or for any consequential, punitive, special or indirect loss or damages whatsoever (including, without limitation, damages for business interruption, loss of business, or other pecuniary loss) arising out of the use of or inability to use Our Platform, even if We have been advised of the possibility of such damages.
We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of Our Platform or to your downloading of any content on it, or on any website or platform linked to it.
We may have links to third-party website or platforms on Our Platform. Any such links should not be interpreted as endorsement by us of those linked websites or platforms. We will not be liable for any loss or damage that may arise from your use of them. We assume no responsibility for the content of websites or platforms linked on Our Platform.
7. Token, Reward and Blockchain Risks
nGRND does not guarantee token value, liquidity, listing, trading availability, redemption, price stability, future claimability or continued access to any token, reward, platform feature, exchange, launchpad, or third party service.
8. Wallet and Transaction Responsibility
Each user is fully responsible for their own wallets, private keys, seed phrases, wallet compatibility, transaction approvals, blockchain fees, gas fees and irreversible blockchain transactions. nGRND will not be responsible for any of these items, actions or activities.
9. Restricted Jurisdictions, Sanctions and Eligibility
Users must not be located in sanctioned or restricted jurisdictions, must not be considered sanctioned persons, must be legally allowed to use Our platform under their local laws, and must meet any minimum age requirement in their jurisdiction of residence. Additionally, in order to purchase tokens or claim any rewards, users may be required to undergo KYC / KYB / AML review and certification. Any User that does not undergo and pass any required review or certification will not receive tokens or be able to redeem any benefit from Our Platform.
10. Proprietary Rights
We are the owner or licensee of all intellectual property rights on Our Platform, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
You must not use any part of the content on Our Platform for commercial or business purposes without obtaining a licence to do so from us or Our licensors.
11. Malware and Usage
You are responsible for configuring your information technology, computer programs and platform in order to access Our Platform. You should use your own malware protection software.
We do not guarantee that Our Platform will be secure or free from bugs or malware.
When using Our Platform, you agree not to (i) use any robot, spider, scraper or other automated means to access Our Platform; (ii) use any robot, bot, spider or any other means to take advantage or Our Platform or to increase your position, tokens or earnings on Our Platform in any way; (iii) Us any method of multi-accounting, referral abuse or reward farming; (iv) take any action that imposes an unreasonable or disproportionately large load on Our infrastructure; (v) Post anything contrary to Our public image, goodwill or reputation; or vi) Use Our Platform for any unlawful or unauthorized purposes.
12. Right to Suspend, Ban, Reverse or Withhold Rewards
Any user to be found violating these policies in any way, such as creating or controlling multiple accounts, any abuse of the referral systems, any use of account farms, emulators, fake accounts, VPN/proxy manipulation, scripts or coordinated activity to unfairly increase rewards, balances, leaderboard position, token allocation or platform earnings will be dealt with immediately and severely. nGRND may suspend accounts, restrict access, remove balances, cancel rewards, reverse incorrect allocations, deny claims or block users where fraud, botting, abuse, technical error, exploit activity, sanctions risk or breach of these Terms and Conditions is suspected.

16. Applicable Law and Entire Agreement
These Terms are the entire agreement between you and nGRND for your access to and use of Our Platform.
These Terms are governed by, give effect to and are construed in accordance with the laws of the British Virgin Islands, and each of the parties to the Contract agrees to submit to the non-exclusive jurisdiction of the British Virgin Islands courts with regard to any claim or matters arising under these Terms.
